Terms of Service

These Terms of Service ("Terms") govern your access to and use of websites, products, and subscriptions operated by Dymension Studios ("we," "us," or "our"), including dymensionstudios.com, the Dymension Platform, DymenWeb, client portal, and related services (collectively, the "Services").

By creating an account, starting a subscription, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Accounts & eligibility

You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account. You must be able to form a binding contract and use the Services in compliance with applicable law.

2. Subscriptions & plans

We offer Free, Member, and All Access plans (and may offer custom agency or project engagements). Paid plans renew according to the billing interval you select (monthly or annual) until canceled. Fees are described on our Pricing page or in a separate order/SOW. Taxes may apply.

Free tier access may include limited previews, email-gated content, and evaluation use. Paid features (including DymenWeb and portal tools) require an active qualifying plan or project agreement.

3. Acceptable use

• Do not misuse, disrupt, or attempt unauthorized access to the Services
• Do not upload unlawful, infringing, or harmful content
• Do not resell platform access except as expressly permitted in writing
• Do not reverse engineer or scrape the Services beyond ordinary use

4. Customer content & sites

You retain ownership of content you submit. You grant us a limited license to host, process, and display that content as needed to provide the Services. You represent that you have rights to the content you upload and that it does not violate law or third-party rights.

5. Payments

Paid subscriptions and invoices are processed through our payment providers (including Stripe). By purchasing, you authorize charges to your selected payment method. Late or failed payments may result in suspension of paid features. Refunds are governed by our Refund Policy.

6. Intellectual property

The Services, branding, software, and documentation are owned by Dymension Studios or its licensors. Except for your content and rights expressly granted, no IP rights are transferred to you.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or specific business results from AI or automation features.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYMENSION STUDIOS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/DATA. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

9. Termination

You may cancel a subscription according to your plan settings or by contacting us. We may suspend or terminate access for violations of these Terms, non-payment, or risk to the platform. Provisions that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.

10. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes become effective constitutes acceptance.
